What are the main areas of case law?
Case law:
There are two main areas, as follows:
• Common law: It is an amalgamation of past cases that are used to make decisions onto cases brought to court nowadays They have developed over time as an outcome of local customs and cases being determined, and have formed the backbone of judicial precedent (earlier decisions made through judges onto cases). Common law is updated like a result of new cases being determined. Judicial precedents made through higher courts are binding onto lower courts.
• Equity law: It supplements common law through filling in the gaps when there was a lack of fair dealing in several cases. One of the major problems with common law was which its remedy for persons which had won the case was only damages. Delay within bringing a matter to court into reasonable time will not be good into equity law.
