Explain Workmen Compensation Act 1923.
Workmen Compensation Act 1923: The significant terms in the Workmen Compensation Act 1923 are as below:
a) Dependents: It means - a widow, a minor son, a widowed mother or unmarried daughter, and when wholly or in part dependent on the earnings of the worker at the time of her or his death'
- A widower, unmarried sister and a minor brother
- A widowed daughter-in- law,
- A minor child of predeceased daughter.
b) Minor: A person under 18 years of age.
c) Partial Disablement: It means disablement of temporary nature and that reduces the earning capacity of a workman.
d) Total Disablement: It implies this disablement which as temporarily or permanently incapacitates a workman for all work and he cannot earn at all for forever or a period.
e) Workman: It means a person (that is other than one whose employment is of casual nature and who is working otherwise than for the reason of the employer's trade or business) who is
(i) A railway servant and not permanently working in any administrative capacity.
(ii) Getting wages not exceeding:
Rs. 500 according to Act of 1923
Rs. 1000 according to Act modified in 1976.
