Question: You are dealing with a company, based out of Forget, Saskatchewan. You have been asked to look into an issue with a small pharmaceutical company based in Forget, BB Incorporated. BB is owned by a fellow named Gus Fring, and the two employees involved are Walter White (a production manager), and Jesse Pinkman (a production worker).
Jesse has come to Gus with a complaint about Walter - he says that Walter is bullying him. When Gus asks what Jesse means, Jesse says that Walter is constantly watching him work over his shoulder, which is causing a lot of stress and anxiety, and having a serious effect on his ability to work in production. Walter constantly makes comments about how Jesse needs to "work better" and "work faster". Jesse says that, at one point, Walter said to him that "a skinny white kid like you should be able to do this better". Jesse says that Walter has even hit him once in the back, to prod him to work harder.
To start with, you are an HR and Safety consultant, and Gus has come to you for advice on how to deal with the situation. Tell Gus what steps he needs to take to deal with Jesse, and Walter. How would you investigate this matter?
After you have advised Gus, you magically transform into an occupational health officer. You have learned that Walter has fired Jesse, saying that he wasn't meeting production standards. It turns out that the firing took place very shortly after Jesse went to Gus with the complaint about Walter. Jesse has now filed an anti-discrimination complaint with you, as an OHO. Please write a short decision dealing with Jesse's complaint. If there is an area where you need more information, please put it in your decision.
