Question - JUAN is a nursing student who is interning with the city's fire department as a paramedic assistant. EMILY is a licensed paramedic who has been with the fire department for 23 years. On day after their shift, JUAN and EMILY decided to grab a drink at the bar across the street before they went home. While they were at the bar, they saw a commotion occur on the other side of the restaurant. They saw someone on the ground, and a woman scream, "Help! He's having a heart attack! Please help!" Unfortunately, the ambulance and on-duty paramedic across the street were at a different station, so immediate help was not available. The woman screamed, "Is there a doctor in the house? Please help him!" JUAN, who promised his family he'd be home for dinner, did not want to get involved because he would be late, and EMILY, who was married and was afraid that her husband would find out that she was with the intern at the bar, both decided that they would quickly pay their bar bill and quietly walk out without providing any help. After all, they reasoned with themselves, they were off-duty and that surely someone else could provide first aid, and if not, the ambulance would surely arrive soon. No one else came to help, and the person died before the ambulance arrived. 4 When the police found out that JUAN and EMILY worked that the fire department and had left without helping the victim, they charged both with the state's new law that states: It is unlawful for any trained medical professional, including doctors, nurses, paramedics, and first responders, to knowingly and intentionally refuse to render aid to another, if the medical professional has knowledge of the person's peril and was capable of rendering aid without himself or herself being placed in danger. The judge denied all challenges to the law, including that it is void for vagueness. The case proceeds to trial.
