1) If you were the defense attorney representing Mayo would you try to negotiate a plea agreement on his behalf or go to trial?
This is a crazy question, I would not have a choice if I was a public defender but to protect Mayo. Depending on the how it goes in the state, I would try my best to pick a case that is winnable.
In all regards to Mayo, I would go for a plea that would get Mayo some help. I would go for Self-Defense, but I would also seek help for his drinking issues.
His impairment of drinking at work could have prevented him from instigating the argument with a weapon or putting in the position he chose as an only means to the issue that happened in the bar.
2) The prosecutor is given a lot of discretion in the criminal court process. If you were the prosecutor would you try to negotiate a plea agreement or go to trial? Discuss why and make sure to support your position. Also, discuss the pros and cons to each.
After reading the statements, I think it would be hard as a prosecutor to obtain a conviction of murder. I would push for a plea agreement instead of trial.
Many of the witness in this case failed to give valid argument to the whole issue that occurred in the bar. It also seems like this is a small town, and the trial by jury would go in favor of Mayo because he is know more by the locals than Scowen.
