Worker Refuses to Work

On a construction site where a ½ finished, 20,000 square foot steel building is being erected, an employee refuses to work because he feels that the walls might collapse and kill him. You are the supervisor and know that the job must be completed in order to keep your job and good standing with your boss. The worker has a unique specialty, and cannot be replaced easily. You believe that the building is safe enough. You suspect that the worker wants a pay raise and/or is just exerting control over you and the construction progress.

1. Do you have to pay him while he refused to work?

2. Devise a strategy and use OSHA standards or other recognized worker rights statutes/laws/court decisions to justify your actions and comments.
