Fred, an artist, offers to sell Jane a painting for $50. Jane responds that she needs more time to consider Fred’s offer. The next day Fred dies and the value of the painting increases in value to $2,000. Jane calls Fred’s widow, Wilma and says, “ I accept Fred’s offer to sell the painting”. Wilma refuses to sell the painting stating that there was no contract.
