Question: Suzanne is a paralegal at a major law firm. She is asked to help at a court appearance and must drive to the court. On the way, she decides to stop at a fireworks shop. It is almost the Fourth of July, and her children would love it if she got them some fireworks. She takes the freeway exit and follows the signs until she gets deeper and deeper into a rural area. When she gets to the fireworks stand, she starts picking up the fireworks and then accidentally drops the bag onto another customer's foot, causing injury to the customer because it was a heavy sack.

If the customer sues the law firm (employer) under the theory of respondeat superior, will the customer recover from the law firm?

Instead of purchasing fireworks, Suzanne decides to hit the dry cleaner and pick up some suits for work. The dry cleaner is only five minutes off the route to the courthouse, and going there on the way to court will save her time. At the dry cleaner, she does not find anyone at the front counter. In an effort to get an employee, she ventures into the back, calling as she goes. The floor is uneven, and she trips and twists her ankle. If Suzanne attempts to sue her employer under the theory of responeat superior, will she probably win the lawsuit?
