Question

Frank was an employee with 13 years of service and a previously clean disciplinary record who was dismissed for standing a fight when he punched his co-worker and continued to kick him after he fell to the ground. ( Their argument was work -related and started when the co-worker accused Frank of " not pulling his weight".) Frank grieved his dismissal. What are the arguments for the employer? The employee? Who do you think would be successful and why?

Sameera , an employee who worked in one of the retail outlets in a mall, slipped and fell on a patch of ice in the mall parking lot on her way to work. She injured herself and then sued the owners of the mall for damages. The mall owners appealed to the WSIB, arguing that she was eligible for WSIB benefits. The parking lot was a " camera area" owned be mall's management company. The employee had parked in the portion of the lot designed by the employer for employee.
