1. Crane, Poole & Schmidt (CPS) is a law firm in Boston and on an almost daily basis uses a freelance bike messenger named Todd (who uses his own bike and messenger bag). One day Denny Crane, a partner in the law firm, tells Todd he needs a package delivered as fast as possible to the District Attorney. Furthermore, Denny tells Todd not to use Boylston Street, but rather St. James Avenue to get to the back entrance of the courthouse. In Todd's rush to get the package delivered he runs over a pedestrian that gets seriously injured. Because Todd has almost no money, the pedestrian wants to sue CPS for his injuries. What arguments can the pedestrian make for why CPS is liable, and what is CPS likely to argue for why they aren't liable?
