Question: Suppose that Congress gives the Department of Homeland Security (DHS) new authority to regulate the security of high-risk chemical factories (Homeland security Appropriations Act of 2007 , P.L. 109-295). Included in the act is a provision authorizing any congressional committee, by majority vote, to suspend the effective date of a DHS rule adopted under the Act. If a rule is suspended by such a committee vote, the rule remains suspended until the committee votes to withdraw its hold. Is this provision constitutional? Why or why not using precedential case law? What if the Act provided that any committee can stay the effective date of the rule for 90 days?
