Question - Why is it clearly illegal to engage in a political protest in the middle of a busy intersection at rush hour, but it is not illegal to engage in the exact same protest on the sidewalk next to that intersection?

Isn't the arrest and prosecution of the protesters in the intersection a violation of their free speech rights? Why not? Do you think that this theory of the 1st Amendment is correct?
