At the national level the court system has 3 layers. 

  • Lower courts conduct trials.
  • Appellate courts hear appeals.
  • The Court renders a final verdict.

Most cases start in a state level court and work their way through the system.  Very, very few ever reach the Supreme Court and the Court decides which cases it will hear.

There are appellate courts (or circuit courts).  There are specialized courts.  The U.S. military runs its own separate court system.  Again the federal court system is complicated (and that is even without adding the state court systems into the mix!)

Please watch the video linked to this Assignment folder to learn more about which cases get to the Supreme Court.  Once you have watched the video, please answer the questions below.  As always, the questions are due by midnight on Sunday.  This assignment is worth 20 points.

  1. Who decides if a case will reach the Supreme Court?
  2. Why do you think they don't pick every case that is appealed to them?
  3. For any case that Is heard by SCOTUS, what is the goal?  (Especially since the facts of the case have already been determined in a lower court.)
  4. Please tell me the 3 categories that cases heard by SCOTUS usually fall under.  Also explain what each of those categories means.
