Fact Scenario: Frank is an independent contractor and a known prankster working at the offices of Untame Workplaces, Inc., a manufacturer of fireworks. One day, Frank is in the office with his co-workers Charles and Barbara, who are both employees of Untame. Just as Charles is sitting down to work on inserting fuses into bottle rockets at his work station, as a joke Frank violently yanks Charles's metal chair out from under Charles. The chair hits Barbara in the leg, breaking her ankle. As the chair scrapes shoots across the cement floor, it also creates a spark. The spark ignites the gunpowder near Charles's station, making the chair explode into pieces. A metal shard from the chair hits Frank in an eye, permanently blinding him in that eye. The chair is made by Merman Hiller Chair Company. Meanwhile, Charles, who suffers from anxiety disorder, has a panic attack from the sound of the explosion.
