The Deposit (which shall not exceed ten percent of the Purchase Price) shall be paid to the Vendor's Legal Practitioner in cash or cheque drawn on an Australian Bank. Despite the provisions of Section 9AA of the Act, the Purchaser agrees to release the Deposit to the Vendor at the earlier of:

(a) being served the Early Release of Deposit Request; or
