Problem

Read the fictitious scenario below and select the most correct answer: NUMSA, a trade union, lodged a complaint with the Department of Labour on behalf of its members employed by Jozi Storage (Pty) Ltd concerning the state of the Greenpoint building at 22 Pine Street, Johannesburg, where some of its members work. The premises were inspected by the Department of Labour in April 2022 and following the inspection, the Department of Labour issued a restriction notice to an individual who was found operating a forklift without the required certificates and training; otherwise, direction notices were issued regarding the necessity to assess noise levels and air quality. The National Institute for Occupational Health (NIOH) conducted surveys on the area noise in the plant room and the building's indoor air quality in June 2022 and found that the noise rating limit was exceeded in two of the four places evaluated, and that air velocity and relative humidity did not meet suggested criteria in a number of offices on different floors. In light of the findings of the above reports, Jozi Storage (Pty) Ltd intentionally refuses to comply with its statutory duty to provide a safe working environment at the Greenpoint facility. Which legislation will NUMSA need to rely on to take further action against Jozi Storage (Pty) Ltd?
