Question: There are many different types of discovery of a civil litigation case. Like oral deposition, written deposition, interrogators, request for production or permission of inspection, physical or mental examination and admissions. Discovery is a process of exchanging information between the parties about the witnesses and evidence they I present at trial. The primary purpose of is to make sure each party is where the evidence, and to prevent a trial by ambush. Michigan criminal procedure states that the prosecutor has an obligation to provide the defense with all the evidence prior to the trial. but that doesn't always mean that the prosecutors will hand over every single piece of evidence. If a defense attorney start to realize or notice that the discovery is incomplete. That defense attorney may find it necessary to file with the courts calls a motion. Which is a process to order the opposite team to turn over any missing evidence. Failure to provide evidence can lead to a dismissal.
