Answer these Criminal law questions?
1. You have been stopped by a police officer because your brake light is out. Your brother, whom you suspect has a drug problem, throws something under your seat. The officer asks if he can look around. What do you do?
2. A police surveillance team is monitoring your house because it believes you are growing marijuana in your attic. The team wants to use infrared cameras to locate heat sources in your house. Do they need a warrant? What if they suspected you of growing drugs to fund terrorist organizations, do they need a warrant then?
3. Assume the same facts in the first part of the question above, and that the police believed they needed a warrant to use infrared cameras on your house. What standard of proof would the officers need to convince the judge to issue the warrant?
4. A rape occurred in your apartment building. The police go door-to-door to gather information. When they knock on your door, they do not announce that they are the police and you open the door without asking who is on the other side. You're kind of buzzed and forget that your marijuana is sitting in plain view on your coffee table that is visible from the door. You tell the police investigator that you know nothing about the rape, but the investigator clearly saw the pot on your table. If the police investigator chooses to pursue the matter, is a warrant necessary?
5. You are wearing clothing that identifies you as a member of a street gang. Based on your dress, do the police have probable cause to arrest you?
6. You are at home one evening when the police break down your door telling you they have a search warrant to search your property. You are handcuffed and forced on the floor while the police ransack your house. All they find is an unregistered handgun that violates local ordinances. When you finally get to see the search warrant, you point out that the name on it is not yours and the address is incorrect. Can the police use the evidence from this search to prosecute you on weapons charges?
7. A policeman pulls you over for a moving violation. You provide him with your driver's license and registration. He notices a bundle covered by a tarp in your backseat. He asks you what is under the tarp. Do you have to answer him?
