Question:  To find a relevant case to use:

  1. Go to the NKU home page
  2. Under "Quick Links" on the top right, open and then click on library
  3. On the library website, scroll down to "database list" under "start my research" in the middle and click on "database list"
  4. Under A-Z Databases on the next screen, click on the upper case "g"
  5. Scroll down and click on Google Scholar NKU
  6. Click on "Case Law" on the bottom right and then click on "Federal courts" on the bottom left and then list a topic in the topic box at the top under Google Scholar. Choose a topic from any chapter in our textbook, for example, freedom of speech, doctrine of sovereign immunity, etc.
  7. You should now see a list of cases. Click on a case link and review the case to see if it is a case you would like to brief. You may choose any case you would like. You might have to review more than one case before you find one you would like to brief
  8. When you submit your case brief here on Canvas, you must also submit a copy of your chosen case as well
  9. How to Brief Your Case:
  10. Write the complete case citation across the top of your page. Then, list Facts, Issue, Holding and Rationale. You must include all these categories as described below to earn full points for this Case Brief assignment.
  11. Facts: Briefly describe (in a few paragraphs) the facts (background) of the case. This is usually described at the beginning of the case. What happened that brought this case to court?
  12. Issue: What is the issue the court is ruling on and considering in this case? The issue is usually one or two sentences, and is usually found in the middle of the case.
  13. Holding: What did the court decide? This is also known as the ruling of the court. It is usually only a sentence (or even just a few words) long and is usually the last sentence in the case.
  14. Rationale: Why did the court decide the way it did? What were the reasons for the court's decision? The court will usually look at statutes, Constitutions and/or the common law and prior precedents in describing its rationale.
