Question: Should it be a crime to be a member of a gang? If you answer yes to that question, explain why you think it should ben illegal to be a gang member. What type of evidence would you want in order to prove membership in the gang? How would you go about proving the gang's existence? If your answer to the question is "no", why do you think gang membership should be legal?

Here in California, gang membership is not illegal. However, committing crimes on behalf of a gang, in association with a gang or at the direction of a gang are crimes. Check out Penal Code section 186.22 if you want to read about this allegation in greater detail.
