Case Study:- Nadia is the head of marketing for 'Your Adverts Ltd' and she has a meeting to get to in London. Nadia is driving along a country road when suddenly a driver by the name of Alex crashes into her car from behind. Nadia luckily survives but sustains serious injuries to her back. Her car is a write-off and she is completely shaken up by the incident. This is the first time she has been involved in a car accident.
Alex, also shaken up by the incident, has a few head injuries but these do not appear to be serious as from the police report, the airbag in his car softened the impact of the collision. The police report notes that Alex was driving at 90 mph but Alex claims he was avoiding a fox which had suddenly appeared on the road.
You are a solicitor working for Rexton LLP. Nadia comes and sees you and is very upset at what has happened to her. She says she wants to pursue a claim against Alex and believes he was recklessly driving his car on the country road. She maintains she was driving carefully at 40 mph as there were cameras on the country road and so she was careful not to go over the speed limit of 50 mph.
In light of the Civil Procedure Rules UK, advise Nadia of the relevant procedure and stages to bring her claim with reference to the following:
Question 1:- What track will follow the serious injuries to the back?
Question 2:- What matters would you deal with in the initial client interview? Where appropriate outline briefly any questions or advice you would have for your client.
Question 3:- Explain with reasons what evidence you are likely to require to obtain compensation for your client, and how you might obtain it.
Question 4:- What 'case management directions' do you consider are most likely in this case, and why? You should fully explain the steps that would be undertaken to comply with the case management directions.
Question 5:- What steps would you take in the event that evidence helpful to your client's case is in the possession of a third party (include in your answer discussion and description of the process of any court hearing that may be required, and any forms required)?
