Michigan v. EPA, the EPA decided to become self-appointed champions of what their air standards should be. The EPA did this without taking into account how expensive those new standards would be, as the industry players w=ould have to incorproate pricey parts, process to be in compliance iwth the EPA's Rules. Thus, we have a case where the issue is whether or not an agency can regulate air emission standards without taking into account the costs of those standards....ultra vires. What is the actual result here? Is the EPA's rule "thrown out" entirely? Or does the agency just "go back to the drawing board" to do a cost-benefit analysis to justify its rule?

What kinds of costs, and what kinds of benefits, do you think should go into the EPA's cost/ benefit analysis?
