Question

What should we do with sleepwalkers? You saw that in Parks the accused drove across town and killed one person and tried to kill another. Ultimately, Parks was acquitted when he raised the defence of non-insane automatism. However, more recent cases, like Luedecke, suggest that if tried today Parks would have to use NCRMD as a defence instead. In your post consider the condition of sleepwalking. Do you think this should be a defence to a criminal offence? And if so, how should we deal with it? In your answer consider the Court's desire to protect the public while infringing on the freedom of the accused as little as possible.
