Emily was a sales representative for TCP when TCP announced the details of a bonus plan. The details provided that any sale representative who achieved 100% year-over-year sales growth and a 42% profit margin would earn 200% of his or her base salary as a bonus. However, TCP retained absolute discretion to modify the plan. Emily met the sales and profit benchmarks and therefore expected a bonus of$85,945 based on her base salary of $42,500. However, TCP could not afford to pay that amount and instead paid Emily $35,000. Emily sued TCP for breach of contract. What should be TCP's defense? Will it prevail?
