Question - Case Study

At a dinner in the Philippines a man with his child was eating then suddenly a drunk group made a scene. The man wanted a CCTV footage and he tried to speak to the manager personally but was referred to as the security guard. After a few days of following up on his request, he was finally informed that the establishment would not provide him any data. This infuriated him and, upon going back to the restaurant, he demanded his right to view the footage, or else he would file a formal complaint to the National Privacy Commission. He was told that, as per their security policy, no "outsider" is allowed to enter areas in their establishment designated only as "for employees only". As a compromise, the manager said they would give him a record of the footage using the customer's handheld gadget.

Questions -

1. What rights of the data subject are illustrated in this scenario? Explain.

2. What right may have been violated if the manager steadfastly refused the request to view the CCTV footage? Explain.

3. Instead of barging into the restaurant furious because of the refused request, what would have been the proper steps taken in obtaining the CCTV footage? List the steps.
