CASE STUDY -
Ben and Julia were childhood sweethearts and they married five years ago. They have three children Jack, aged 4, and twins George and Ella, who are 2. Ben works long hours as a top executive in a multinational company. Julia is a stay at home mother as Ben does not believe that children should be minded by strangers.
Ben is a perfectionist who expects Julia to have the house in pristine condition all of the time along with his dinner ready when he arrives home and the children to be on their best behaviour during the limited times he sees them. He often send messages to Julia on social media with pictures of families with seemingly picture perfect lives with the caption "why can't this be us?"
Julia was coping with Ben's demands until the birth of the twins. Julia suggested to Ben that she get some help with the household but Ben refused saying that it would be a waste of money and that Julia should be able to manage as she had nothing else to do. Ben then started to verbally abuse Julia telling her she was useless and using derogatory language towards her generally.
Since Julia was at home with the children all of the time she had little contact with other adults. She found herself alone and isolated with no one to confide in. She was too ashamed to talk to her family as she really believed she was a failure.
One evening Ben arrived home after a particularly difficult day in the office. Julia also had had a hard day as the twins had both been vomiting and Julia had just managed to settle them when Ben arrived. No dinner was ready and the house was not up to Ben's standard. Ben completely lost his temper with Julia and started lashing out physically at her. Jack arrived downstairs to his mother lying on the ground unable to get up. While lying there and seeing Jack, Julia vows to herself that she has to do something.
Q1. Under the current domestic violence legislation, what options are available to Julia? (650 words)
Q2. Are there any provisions of the Domestic Violence Act 2018 that would be of benefit to Julia once they are commenced? (650 words)
Q3. Has the Domestic Violence Act 2018 gone far enough in addressing the shortcomings of the current legal regime regarding domestic violence in Ireland? Explain your answer using academic commentary to support it. (1,200 words).
