Case: Consider the following scenario and post your idea of what the suspect could potentially be sentenced to: an infraction, a misdemeanor, or a felony and how/where could they potentially be sentenced: Fine, county jail, or state prison. Post your answers:
Robert was driving 45 MPH in a school zone posted at 25 MPH. An officer observes him and captures his speed on radar, then issues Robert a ticket and he arranges a court date to appear to contest the charges. Robert never shows up for court, nor does he pay the fine or sign up for traffic school. The court issues a "Failure to Appear" notice to DMV, which then suspends Robert's driver's license. Robert keeps driving anyway, even though he received a notification of his suspension in the mail. One night, Robert is driving home after work and drives through a DUI check point where officers are briefly contacting passing motorists to see if they are intoxicated. When Robert is contacted by an officer, he is not drunk, but it is still determined that his driver's license is suspended due to the fact that he never took care of the speeding infraction ticket.
Question: Name the crimes Robert has committed to this point (in plain language-no codes are necessary). What level of crime(s) can Robert be charged with for each crime? What is the most significant sentence he can get for each crime: Fines, a County Jail sentence, or a State Prison sentence, or any combination of these. You might try looking up "California Penal Code 1320"
