When Justice Antonin Scalia died in February 2016, President Obama proposed Judge Merrick Garland to replace Scalia, but the Republicans simply refused to hold hearings on his replacement, citing that, in an election year, no presidential nominees should be given a hearing. Yet, in September 2020 after the passing of Justice Ruth Bader Ginsburg, the Senate Republicans vetted and voted to approve a new justice, Amy Coney Barrett. What is the Senate's responsibility in confirmation politics? Does the president's nominee deserve an up-or-down vote on the Senate floor? Can, and should, senators use whatever procedural means are at their disposal to influence the composition of the judiciary? Are these disputes over the composition of the federal judiciary an example of partisan politics at its worst, separation of powers at its best, or both?
