1) You have accepted a job as a financial analyst for a healthcare company in Connecticut that only serves customers in Connecticut. The employer requires you to sign a non-compete agreement which includes the language below:
Non-Competition. You covenant and agree that, during the term of your employment with the Company and for thirty-six (36) months after the termination thereof, regardless of the reason for the employment termination, you will not, directly or indirectly, anywhere in Connecticut, Massachusetts, or New York, on behalf of any Competitive Business perform the same or substantially the same Job Duties.
You are fired by the company and decide to take employment with a healthcare company in Massachusetts. Your prior employer sues to enforce the non-compete agreement. Is the non-compete enforceable? Explain in one paragraph why or why not and support your answer. Although we had a presentation on it this week, if you don't remember from the discussion, you can do some basic research to find out what makes a non-compete enforceable or not.
2) After you have read the wrongful discharge materials (2 pages), answer the following question:
You are an employee at will and most co-workers consider you to be "high maintenance". You complain quite a bit, are always claiming to be overworked, rarely meet deadlines, and are difficult to deal with in a team setting. You recently have complained about being sexually harassed by your manager and there is an investigation which just started. Your manager sees this as the last straw and fires you. Do you have a claim for wrongful discharge? Answer in one or two brief paragraphs.
