Using this case study:

  • Cobb Medical Center, is a non-profit, secular organization, located in East Texas that uses an outside vendor to conduct its background checks on all employment candidates regardless of the type or level of position applied for. This has been the medical center's established practice for many years, since conducting background checks in-house would be time consuming and expensive. To keep the costs reasonable, the medical center only authorizes reference and background checks on candidates that have successfully completed the interview process and where a tentative offer has been extended. When a candidate fails to clear the background check, HR generates a form letter letting the candidate know that they haven't been selected for the position and wishes them well on their job search.
  • The new Vice President of Human Resources, Mr. Adam Wells, wants to confirm that the existing process of handling candidates whose background check didn't pass scrutiny is compliant with applicable federal laws. Mr. Wells wants you to check this out. You're expected to research this matter, and then provide Mr. Wells' with your recommendation and supporting rationale.
