You operate a corn maze and hayride in Maryland (a state without an agritourism statute). You charge customers to come on the farm, sell them food and drinks while there, and offer other products for sale. Prior to each season, you inspect the trailer used for the hayrides and inspect the maze to ensure no defects or safety issues. Each day your employees inspect the trailer to make sure there are no issues that have developed. You also warn customers while in the corn maze to watch their steps for rocks and other things that could injure them and you warn parents to monitor their children while in the maze. Hay ride operators warn riders before it starts to remain seating and parents to keep their children seated while the trailer is moving. One day, two parents allow their children to run through the corn maze, one child trips over a rock, and breaks an arm. The parents are now suing you for negligence. Based on this info answer the following questions.

What is the status of the injured child and what is the duty of care owed to the child?

Do you potentially have a defense in this case? Briefly explain what the defense would be.

Now imagine that you are in Maryland, would the recreational use statute apply in this case? Why or Why Not.
