Question: Discrimination Claims. Radio Free Europe and Radio Liberty (RFE/RL), a U.S. corporation doing business in Germany, employs more than three hundred U.S. citizens at its principal place of business in Munich, Germany. The concept of mandatory retirement is deeply embedded in German labor policy, and a contract formed in 1982 between RFE/RL and a German labor union contained a clause that required workers to be retired when they reach the age of sixty-five.

When William Mahoney and other U.S. employees (the plaintiffs) reached the age of sixty-five, RFE/RL terminated their employment as required under its contract with the labor union. The plaintiffs sued RFE/RL for discriminating against them on the basis of age, in violation of the Age Discrimination in Employment Act of 1967. Will the plaintiffs succeed in their suit?
