1. A patient is seen in the office where you are employed. The dentist recommends a treatment plan and offers alternative treatment that includes identification of the risks involved. The patient declines to have any of the treatment completed. This discussion is not recorded in the record. Five years following the office visit, the dentist is informed that a lawsuit has been filed against her. The patient claims that he never knew about the consequences of not taking care of his oral health as recommended by the dentist. What is the dentist's defense? What should have been done at the conclusion of the consultation to avoid such action by the patient against the dentist?
