  1. What is the definition of bail?  What is the general history of bail?  What does the U. S. Constitution say about bail?  What is bail reform and how has it been implemented.  Finally, Illinois, among other states, have significantly changed its bail system in the last year.  What is the change and is there any commentary or research on how this change is working?

Diversion is a concept which keeps persons arrested or charged with a crime out of the criminal justice system until a trial and determination is made.  What are some of the different kinds of diversion which are currently in use in the country.  Pick out two diversion programs, and review any research found concerning the two diversion programs have chosen.  Provide a short commentary regarding if the programs chosen are effective in diverting persons from jail. Using remaining out of jail during the pre-trial period as your benchmark, how effective are the two programs you have chosen. Does successful diversion assist other portions of the criminal justice system?
  3. Many people who are assigned to a jail pending trial are mentally ill.  Provided with what you know and what you research, how much of an issue is this for the criminal justice system?  Be specific regarding what housing the mentally ill does regarding housing of offenders, treatment of these offenders (what is there requirement to do so), and the impact their presence have on staff who work within the jail.
  4. What is the Prison Rape Elimination Act?  Are jails in North Carolina required to apply to the Prison Rape Elimination Commission to have their jail audited and certified by the guidelines of the commission? The commission have promulgated many standards which have to be audited and in compliance to meet certification requirements.  Please review the major sections of the PREA standards and in your response indicate how you might show it in compliance. No matter if a jail is undergoing PREA review may staff generally be held criminally accountable for violating the sexual safety of an offender?
  5. Plea and charge bargaining is used by most every jurisdiction in this county.  Explain what plea bargaining is and provide a basic description of how such bargaining works.  Do the same for charge bargaining.  Provide some pros and cons of this sort of bargaining.  In North Carolina, how many cases are disposed of using such bargaining.  Many people, researchers and practitioners believe this process provides one group of people in the criminal justice system have too much power because of this bargaining.  Which group allegedly have too much power.  Is there evidence this is true?
  6. Often organizational theorists review the vision, mission, and core values of an organization, like a jail.  Provide a definition of each component.  Of the three, which is the most important and why?  This is an opinion question and there is no right or wrong answer.  Your response will be graded based on how you provide research indicating which of the three are most important.
  7. What is a direct supervision jail.  What distinguished one.  Provide an analysis of the factors needing to be considered in developing a direct supervision jail?
  8. In the last number of years, jails have been understaffed.  Provide some theories about why this has occurred.  What are some of the operational concerns which have developed because of the understaffing of jails?  Remember we are discussing jail understaffing. Make sure you provide references which support your operational concerns.
  9. What is strategic inmate management?  Please provide an analysis of the component parts of SIM.  Why is the concept an important one?  Do you believe the various components of SIM is followed in most jails or not?
  10. It is known that many offenders who come to jail are using or have used illicit drugs.  Many of these actions are part of their criminal charges.  In the last few years, there has been a process called Medication Assisted Therapy (MAT) to assist with persons who used drugs to either facilitate their alleged crime or were addicted to drugs and used them to provide monies to purchase more drugs.  If you believe it is, why is it important for MAT programs to be successful? How do you justify providing a drug user with another drug to providing the defendant an alternative to the drug they had been using.  What is recognized as the mortality rate of persons using drugs and returned to the community without any sort of treatment?
