Question: Is a viability of a claim for negligence, filed by the victims involved in an automobile accident, valid against the owner of a business who employed a delivery driver, who got involved in the automobile accident after consuming alcohol at an event. The night of the event, the underage delivery driving delivered a last minute order at the end of their shift. The delivery was in the same neighborhood of the event, so the delivery driver decided to go to the event after making that last delivery. The owner of the business did no give permission to the driver to use the vehicle for personal reasons. Would the owner have any defenses to raise to this compliant made by the passengers of the vehicle that the delivery driver collide into since he technically did not authorize the driver to use the delivery vehicle after work?
