CON Investments, Inc. owns and operates a battery factory in Pittsburg. Susan Jackson, a previous employee of CON, notified officials that Con was disposing of toxic waste in the Ohio River. FBI agent Sam obtains a warrant to search the executive offices of CON for possible evidence to support the whistleblower.
While there he finds some child pornography in the desk drawer of Jake Perv, an Assistant VP of CON. He arrests Jake on the spot, handcuffs him, and walks him into the police car.
While outside, Officer Sam notices another smaller building that appears to be on CON property. He asks what the building is and Jake tells him he doesn't know but he thinks CON might use the building for storage. Officer Sam enters the building and begins a search. While there, he finds documents that back up Susan's claim of illegal dumping and confiscates the records.
On the way to the police station, Officer Sam questions Jake about the illegal dumping and tells him that if he cooperates, they will go easy on him for the possession of child pornography charge and Jake sings like a canary, providing details on the illegal dumping scheme. When Sam gets Jake to headquarters, he is read his Miranda rights and booked.
At trial, CON's attorneys argue that all of the charges against CON should be immediately dropped because CON's rights have been violated.
1. Jake also argues that the photos found in his desk drawer are not admissible at trial.
