Joseph Saikewicz, age 77, IQ 10, mental age two years and eight months, has been institutionalized for 40 years. Joseph can communicate only with gestures and grunts. He is unaware of danger. He becomes disoriented when removed from familiar surroundings. He has no living relatives.

His health had been generally good until he was diagnosed as having acute myeloblastic monocytic leukemia, which is inevitably fatal. Untreated, most die within weeks to a few months. In approximately 30 to 50 percent of these cases, chemotherapy can bring about a temporary remission that usually lasts as long as five years Results are poorer for patients over 60. The chemotherapy often has serious side effects, including anemia and infections. Stem cell transplants are sometimes effective when chemotherapy fails.

In April 1976, the probate court appointed a guardian ad litem with authority to make the necessary decision.
