Q1. What Is Law?
Think of some synonyms or one-word definitions of the word "Law."
List a few of them; then answer this question: What is it that makes a law, "Law?" (Must it be obeyed to be a law, for instance?) How do we know if something is "law?"
Q2. What makes a law, "Law?"
After following some of the responses on DQ#1 for a day or two, here is a follow-up question. In this class, (as you may see from my responses to the first DQ), we almost by necessity need to focus on the concept of "what is enforceable" as our concept of "law." It may cover our personal compliance or a business' compliance of statutes and regulations. (For now, don't worry about the way in which laws might be enforced, but discuss this concept):
Is our class focus on "enforceability" (in the posted lecture) a proper or improper context for understanding "law?" In other words, do you agree that we need to discuss legal matters in this class ONLY in terms of "what courts will enforce?" Or should "law" be much more broadly applied? Please refer to information in Chapters of the text, and/or your own concepts of law when explaining your reasoning.
