That someone who is able to commit serious crimes towards others, especially if shown no remorse, themselves should receive the same or similar treatment, if that makes sense. The way I see it is that, when someone is being sentenced they have the right of "cruel and unusual punishment" however, it wouldn't be said for victims, again if that makes sense, and to me that doesn't sound fair. Though I would agree that there is room for some adjustments as to how or when this my be given to certain people. In the case of Marshall Hypothesis, that people would find capital punishment shocking and unjust, is hard to really know, though I would say that I would likely disagree with it. That is due to the fact that as even today there are many people who agree with it and find it necessary, and others who already find it unjustified. That's because everyone has their own sense of justice and what they truly believe is considered justice. Anyone could respond to it differently.

Ruth Santos 2/2/24, 12:18 AM NEW 4C I do not support the death penalty - there are too many "what ifs" for me to consider it a good form of retributive justice. While many inmates convicted and sentenced to death may have been guilty of their crimes, laws like The Innocence Protection Act of 2004 exist because of inmates who were found to be innocent after they were executed (Walker, et al., 2017). I understand our corrections system is overburdened, but is taking someone's life truly punishment for the offender? Would a life sentence not serve their victims better since the person convicted of the crime would suffer more in prison? What if that person is innocent? What if that person was a victim of racial discrimination during the prosecution and sentencing process? Ultimately, there are too many questions about whether it is a valid punishment in modern society.
