Question: Trading Technologies has various patents claiming a method and system for expediting the successful execu--- tion of electronic orders to trade stocks, bonds, futures, options, and similar products. Its patented system displays bid and ask prices dynamically, along with the static dis- play of the trader's desired trading price, and then pairs and executes orders when the static desired trading price equals the dynamic market price. Because this system . reduces the time it takes to place a trade, it increases the likelihood that the trader's orders will be ?lled at the pre~ ferred prices and quantities. After CQG, Inc. began using a similar system, Trading Technologies sued it for patent infringement. In its defense,CG aeserted that the patent claims dealt with patents-ineligiblesilbject matter. What factors should the court consider to determine Whether Trading Technologies' system is patent eligible? Certain experts assert that business process: patents are issued "too easily" and sti?e innovation, while others have argued that applying stricter tests could make software virtually inel- igible for patent protection. What factors should managers and courts consider when deciding Whether software is patentable? Are any other types of intellectual property protection available to protect innovative software?
