What does this mean The other part of this that's somewhat different than what you're used to, perhaps, the rights of criminal defendants. When we talk about the rights of a witness before a grand jury proceeding, bear in mind, when somebody's a witness, they may not be aware that they're actually the target of the investigation. The rights of a witness are not coterminous with the rights that a criminal defense would have in a trial so in this case where Alex was called a grand jury witness in an investigation about a terrorist attack on a subway station. When asked about the purchase of 500 pounds of ammonium nitrate, Alex responded that he had done so on behalf of a third party. When asked the name of the third party, Alex took the Fifth Amendment. The prosecutor argued that Alex could not do so because he has alread disclosed incriminating information and is barred his reliance on the 5th amendment or because there is a clear potential for additional incrimination since alex's guilt or innocence could depend on the testimony of the witness he was asked to identify.
