Case Study: Chapter 21 in Tigar's Law and the Rise of Capitalism-"Leading Schools of Legal Thought," featured in Learning Unit #2-and Chapter Two in Vago and Barkan's Law and Society consider the perspectives and arguments of many of the same legal thinkers and theorists: the natural-law theorists, Sir Henry Maine, and Oliver Wendell Holmes Jr. most notably. Select one of the thinkers or theorists covered by both Tigar and Vago & Barkan and compare how they respectively characterize the viewpoints of that thinker or theorist (on in the case of the natural-law theories, that theoretical school). In making your comparison between Tigar's and Vago & Barkan's treatments, focus on the two following issues:
