Constitution questions: These may be a bit dry, but we rely heavily on Constitutional principles, so I really want to make sure you have read and understood the Constitution!

After looking at the Constitution, why does it matter that each branch stays in its constitutional "sandbox? Why is it a problem if the president makes the laws and executes them? Or if Congress makes the laws and also decides who broke them? Or if judges prosecute violations of the law (ie execute the law) and also decide whether the person being prosecuted actually violates the law?

Federalist Papers (Fed #10 & 51) and discuss the following: You MUST cite evidence from the provided readings

  • Federalist #10: What did Madison mean by a "faction"? According to him, what caused factions? According to Madison, why are factions dangerous? How does Madison refute the prevailing view that democracy was possible only in a small state?
  • Federalist #51: What are some of the limitations of government according to James Madison? Why does the legislature need to be divided? How does this eventually lead to a system of checks and balances which would become a major part of the American government?
  • How do the clauses of the Constitution increase the powers of these branches of government? What clauses in particular do you think are worthy of discussion that connect back to either Fed #10 or Fed #51?
