Fact Pattern #1 Greg, a graduate assistant football coach at Georgia Southern University (GSU), is helping to run the summer GSU football camps for high school students. The camp required a waiver and medical release forms to be signed by parent/guardian and medical doctor before participation in the camp. During the first week of the position camps Greg is instructing the corner backs and receivers. During the drills it becomes apparent that one of the receivers (a 17 year-old-minor) has hands of stone-that is, the receiver is not adept at catching the ball. Noticing that the camper is also particularly quick and fast, Greg decides to move the camper to defense and begins working him into the defensive back drills. During one of the drills the camper is attempting to make a tackle and injures his neck. Greg immediately calls for the training staff who takes over the situation. The training staff immobilizes the camper's neck and transports the camper to the hospital via ambulance. The camper's family later sues Greg and Georgia Southern for negligence stating that Greg didn't instruct their son on the proper fundamentals of tackling after switching him from offense to defense and that the camper had never played defense before and thus tackling was not an inherent part of the game for him. Discuss this case in terms of the four elements of negligence and consider the following questions: What are the facts of this case? Is there negligence? Why or why not? If you believe there is negligence, who all might be liable? Why? What defenses might be useful to Greg? Why? What impact does the waiver play in this scenario? Be certain to use correct terminology and you must cite relevant case law and cases to support your answers.
