As she has done annually in recent years, on February 17, Margo, the Curriculum Manager at the Toss School of Business (TSB) sent an email to Brian, the sales rep. at Law Publisher (LP) requesting a written proposal to sell TSB 148 books for the upcoming EMBA course. On February 19 Brian emailed Margo a signed proposal specifying the price, showing the books would be shipped to the place Margo requested and by the necessary date. On February 20, Margo responded: “Thanks Brian! That sounds great, we have a deal so long as when you ship the books that are coming to Ann Arbor you include one of those LP coffee mugs you’re always giving away. My clumsy office mate broke mine.” Both Margo and Brian had authority to enter into this type of contract. Assume TSB and LP have a contract here and that TSB is not a merchant for the sale of books.
