Bob and Sarah are siblings. They arrived on their parents' employment based visa applications and were admitted to the U.S. as lawful permanent residents. Bob was initially charged with rape and if convicted, he would be facing five to 15 years in prison. His defense counsel was able work out a deal with the prosecution where Bob would plead guilty to criminal sexual assault, which carried a potential prison sentence of six to 12 months. Bob pled guilty and the judge ordered him removed. A few months after Bob was removed from the U.S., he surreptitiously entered without inspection.

About a year after he returned to the U.S., local authorities stopped him for a traffic violation and he was ultimately turned over to ICE. ICE now seeks to reinstate his prior removal order. 1.
