Case: Before reviewing the HIPAA regulations on the Health and Human Services website, my major concern for violation was when a client is at risk of harming themselves or others (OCR, 2020). After reading about how HIPAA helps mental health professionals, I learned that there are several instances where contacting people about a client's mental health is covered under HIPAA regulations. I learned we are always allowed to share information with a personal representative, and we can always share information with family and friends if the client agrees. This statement helped me the most, "A health or mental health professional may contact anyone who is reasonably able to lessen the risk of harm when they believe that a patient presents a serious and imminent threat to the health or safety of a person (including the patient) or the public." It is extremely comforting to know that OCR trusts the judgement of mental health care professionals and that I will never be put in a position where I am afraid to reach out to protect my client or the public, for fear of violating HIPAA regulations.
