Drug testing is a serious item for public employees. Taxpayers want to ensure that public employees are doing what they are supposed to on the job and not engaging in any illegal activity while on the job. Public employers want to make sure that public employees are doing what they are supposed to on the job and not engaging in any illegal activity while on the job. We can generally say that engaging in illegal drug use while on the job is a crime and generally speaking public employees will be prosecuted for it if discovered.

It is safe to say that illegal drug use is not something that is tollerated in the workplace. But what about illegal drug use outside of the workplace? Drug testing can discover drug use that occurred outside of the workplace. Is this something that should be allowed in the workplace? Is it a negotiable item under collective bargaining an a union contract? Is it tantamount to an illegal search and seizure in the workplace? Does it matter what the job duties are?
