The court approved one of the state's plans, stating that it was consistent with the National Contingency Plan, and authorized the state to incur removal and remedial costs of nearly $2 million. The state completed the cleanup and sued Idarado for the response costs. Idarado contested some of the costs, including the costs of preparing the plans not approved by the court and the cost of restocking a stream with fish. Idarado's waste previously destroyed the stream's fishery. Is Idarado likely to be successful in challenging these response costs?"
"Complaints by neighbors near a site formerly owned by Bell Petroleum Services, Inc. (Bell) about discolored drinking water prompted an investigation by the Environmental Protection Agency (EPA). The investigation revealed that the aquifer from which the drinking water was drawn was contaminated by chromium, a hazardous waste. The State of Texas and the EPA cooperatively cleaned up the site and then sued Bell for response costs. Bell denies responsibility because it no longer owns the site and because the governments did not prove that it was Bell's chromium waste that caused the contamination.
