Assignment:

I need to answer these questions:

Are the following actions of a prosecutor legal? Are they ethical?

1. Authorizing the arrest of one brother for drugs (knowing the young man would lose a scholarship to college), even though the prosecutor knows the charge would be thrown out, in order to have leverage so that he would give evidence against his brother.

2. Announcing a suspect of a drive-by shooting to the media so that the offender is in danger from the rival gang members, and then offering protective custody only if the man will plead guilty.

3. Authorizing the arrest of a 10-year-old boy who confessed to a crime, even though there was no serious possibility that he was guilty, in order to pressure a relative to confess.

4. It's your first big case is a multiple murder. As the defense attorney representing the killer, you have come to the realization that he really did break into a couple's home and torture and kill them in the course of robbing them of jewelry and other valuables. He has even confessed to you that he did it. However, you are also aware that the police did not read him his Miranda warning and that he was coerced into giving a confession without your presence.

- What should you do? Would your answer be different if you believed that he was innocent or didn't know for sure either way?
